These Terms and Conditions set out the basis on which Beaufort Nannies (“the Agency”) works with nannies who register for work opportunities. By registering with the Agency, you (“the Nanny”) agree to the following:
- Registration and Eligibility
1.1 All nannies must be over 18 years of age and have the legal right to work in the UK.
1.2 Nannies must provide accurate, truthful, and complete information during registration, including CV, references, proof of identity, and relevant qualifications.
1.3 The Agency reserves the right to decline or terminate registration if the information provided is false, incomplete, or misleading.
2. Safeguarding and Compliance
2.1 Nannies must hold (or be willing to obtain) an enhanced DBS check.
2.2 The Agency may require up-to-date first aid certification and childcare qualifications, depending on the role.
2.3 Nannies must comply with safeguarding and child protection standards at all times. - Employment Relationship
3.1 The Agency acts as an introduction service only.
3.2 The Nanny is employed directly by the family and not by the Agency. The Agency is not responsible for the employment contract, salary, tax, National Insurance, or any other employment obligations between the Nanny and the family.
3.3 The Agency will support both parties with guidance and best practice but does not employ the Nanny.
4. Fees and Payments
4.1 The Nanny is not charged a registration fee by the Agency.
4.2 Any trial period will be paid directly by the family to the Nanny at a rate agreed in advance. A trial fee may be payable by the family to the Agency (not deducted from the Nanny).
4.3 Once a permanent or temporary role is accepted, all salary payments are made directly between the family and the Nanny.
5. Conduct and Responsibilities
5.1 Nannies must act professionally, reliably, and responsibly at all times.
5.2 Punctuality, honesty, and maintaining confidentiality are essential requirements.
5.3 Nannies must not share family information, photographs, or personal details with third parties, including on social media.
5.4 Nannies are expected to comply with the agreed duties, hours, and responsibilities set out in their employment contract with the family.
6. Confidentiality and Data Protection
6.1 The Agency will handle Nanny data in accordance with its Privacy Policy.
6.2 Nannies must respect the confidentiality of both the Agency and the families introduced through the Agency.
7. Termination of Registration
7.1 The Agency reserves the right to withdraw a Nanny’s registration if:
– There is a safeguarding concern,
– The Nanny breaches these Terms and Conditions,
– The Nanny behaves in a way that could damage the reputation of the Agency.
7.2 The Nanny may request removal from the Agency’s register at any time by providing written notice.
8. Liability
8.1 The Agency makes every effort to match Nannies with suitable families but does not guarantee placement.
8.2 The Agency is not liable for disputes, loss of earnings, or issues arising from the employment relationship between the family and the Nanny.
9. Governing Law
These Terms and Conditions are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the English courts.
